Terms of Service

1. Acceptance

By accessing or using the Xeneural platform you confirm that you have read, understood and accepted these terms of service. If you do not agree with any of these terms, you must refrain from using our services. Continued use of the platform constitutes acceptance of any later modification of these terms.

2. Description of the service

Xeneural provides a comprehensive business platform that includes modules for sales, logistics, human resources, accounting and production management, and artificial intelligence tools. We reserve the right to modify, suspend or discontinue any feature of the service at any time, with prior notice where reasonably possible.

3. Accounts

You are responsible for keeping your access credentials confidential and for every activity that occurs under your account. You must notify us immediately of any unauthorized use of your account. Xeneural is not liable for losses arising from unauthorized use of your account when it was not reported promptly.

4. Acceptable use

You agree to use the platform only for lawful purposes and in accordance with these terms. Using the service for illegal activities, transmitting malicious content, attempting to access unauthorized systems or interfering with the normal operation of the platform is prohibited.

5. Intellectual property

All content, source code, designs, trademarks and materials of the Xeneural platform are the exclusive property of Xeneural or its licensors. No intellectual property right is granted by use of the service beyond the limited license needed to use the platform under these terms.

6. Limitation of liability

Xeneural is not liable for indirect, incidental, special or consequential damages arising from the use of or inability to use the platform. Our total liability in any claim will not exceed the amount paid by the user in the twelve months before the event that gave rise to the claim.

7. Modifications

We reserve the right to modify these terms at any time. Modifications take effect when published on the platform. We will notify you of significant changes through the email registered on your account or through a prominent notice on the platform.

8. Feature requests (XEN Overdrive)

Customers may propose new features through the enabled channels. Each request is assessed for eligibility and consistency with the product: priority goes to those that fit the architecture and scope of XEN and those that bring value to the whole set of organizations using the platform. Xeneural may reject, postpone or reframe a request, and does not guarantee specific delivery dates unless agreed in writing in a service agreement. Resulting features become part of the platform and are subject to the intellectual property clause, unless expressly agreed otherwise. Enterprise plans may receive priority attention under the conditions of their agreement.

9. Governing law

These terms are governed by the laws applicable in the jurisdiction where Xeneural has its principal place of business. Any dispute arising from these terms will be submitted to the competent courts of that jurisdiction, unless the parties agree on an alternative dispute resolution mechanism.
